Main Auction Sale

The participation in any of our auctions implies the unconditional acceptance of these Terms & Conditions.

Art. 1 – The sale is executed strictly in cash, Swiss francs and without warranty. For administrative purposes, each buyer will be asked to give a proof of his/her identity in order to obtain an invoice at the end of the sale. Invoices can be settled at the end of each auction session. Buyers can settle the invoice via wire transfer, major credit/debit cards or cash. Payments in cash for an amount equal to or more than CHF 100'000 will not be accepted. Personal or company cheques are not accepted.

Art. 2 – No more bids will be accpted after the hammer strike, unless otherwise communicated by the auctioneer. In case of a dispute at the time of the hammer strike, the auctioneer may at his discretion cancel and immediately put the lot back up for sale.

Art. 3 – The auctioneer, at his/her sole option, can: refuse any bid, move the bidding backwards or forwards in any way he/she decides; change the order of the lots, withdraw any lots, divide or combine any two or more lots, reopen or continue the bidding even after the hammer strike. The auctioneer may bid on behalf of the seller up to but not including the amount of the reserve either by making consecutive bids or by making bids in response to other bidders. In the event that the reserve price set by the seller is not reached, the auctioneer may deem such lot unsold and move on to the next lot by a single strike of the hammer.

Art. 4 – The successful bidder agrees to pay a buyer's premium at 20% of the hammer price on all lots purchased. VAT at 8% is charged on the buyer's premium, giving a total of 21.6% on the hammer price. Internet buyers incur an additional 3% internet fee on the buyer's premium plus VAT (Total premium for internet buyers 24.8% inc VAT). (N.B.: In case of special sales, such as sales taking place outside the Hôtel des Ventes area, a commission of 23% will apply, instead of 20%.)


Art. 4a – For foreign buyers, the VAT collected may be refunded upon presentation of duly completed Swiss customs papers. To avoid administrative fees, reimbursement of VAT will only be allowed if the amount of the VAT is superior to 50CHF.


Art. 5 – Bidding must be placed by spoken voice or made by a distinctive sign unequivocally demonstrating the willingness to bid. The auctioneer, at his discretion, can refuse bids from unknown bidders. The minimum amount of an increment is 10%. However, the auctioneer may modify this rate by announcement.


Art. 6 – The viewing period allows the buyer to evaluate personally the condition and authenticity of the objects. Any dispute will not be allowed once the bidding is over. The objects are sold as seen at the time of bidding. To the best of our knowledge, all indications provided in the sale catalogue are correct; however the descriptions are only the expression of a professional opinion and do not constitute a guarantee. The catalogue may mention some damage to a lot without necessarily providing an exhaustive list. If the low estimate is CHF 1'000 or less there will be no mention of the object's condition. Condition reports are available upon request. Photographs, dimensions and weight are for indication only.


Art. 6a – Foreign buyers shall always check the relevant customs laws and regulations before bidding on any lot containing wildlife material such as, but not only: ivory, tortoiseshell, crocodile skin, rhinoceros horn, or whalebone. Hôtel des Ventes pays particular attention to complete its due diligence duties to ensure that all the objects presented in the catalogue comply with our laws and regulations of Cultural Property (CPTA). However, we are under no obligation to cancel your purchase and refund the amount paid if your lot cannot be exported, imported or if seized by a government authority.


Art. 7 – Lots must be collected at the expense and sole risk of the buyer. To avoid delivery errors and complications in invoice settlement, no lot can be collected during the sale. Unless previously agreed, collection is not permitted before full payment of the invoice. Objects may be collected by the buyer according to the "Payment and collection of lots" as outlined at the front of the catalogue.


Art. 8 – Every visitor is responsible for any damages he may cause to any given object in the sale; he may be charged with an amount equal to the average of the object's estimate plus buyer's premium and VAT.


Art. 9 – All absentee bids are executed with care, discretion and offered as a service to our clients. Telephone bids are accepted from buyers already known to Hôtel des Ventes and for lots whose low estimate is or exceeds CHF 400. In the case a telephone bidder cannot be reached due to technical error or other unforseen circumstances, Hôtel des Ventes reserves the right to award the lot to the telephone bidder on his behalf at the price equal to 50% of the high estimate, unless the reserve price is higher. In addition, any telephone bids will be considered de facto as a written bid of CHF 400. These bidding services are offered as a courtesy to our clients and Hôtel des Ventes is not responsible for any error (human or otherwise), omission or breakdown in providing these services. Your request for this service must be made no later than 48 hours prior to the auction. Any cancellation of absentee/phone bids must be submitted in writing at least 24h before the start of the auction concerned. To be accepted, the cancellation must be acknowledged by the Hôtel des Ventes bidding office or the Court baliff overseeing the auction.

Art. 10 – Title of goods therefore any risk passes to the buyer the moment the hammer falls on a lot. However, ownership of a lot can only be assumed after full payment of the invoice. In case of non- payment after three days following the end of the sale, the buyer is liable to judicial prosecution. Cancellation of the sale will ensue after a 30 day period of non payment if instructed by the vendor however, all fees and other charges will still be due by the buyer.

We give no guarantees as to the condition of the frames and glass.

Art. 11 – Hôtel des Ventes reserves the right to refuse admission or participation in any auction or to reject any bids. Any persons obstructing or disrupting the auction will be subject to police sanctions.

Art. 12 – Hôtel des Ventes reserves the right to accept or refuse any credit card payment. The following cards are accepted at no extra fee: Maestro, Postcard and EC-Direct. Payment by other major cards (MasterCard, Visa, PrePaid MasterCard, PrePaid Visa, American Express and UnionPay) will be subject to a 2% administrative fee.

Art. 13 – Hôtel des Ventes may publish, for advertising purposes, photographs of objects sold at auction in its own magazines and/or through other media channels.

Art. 14 – Any dispute concerning the sale is subject to Swiss law and is under the jurisdiction of the Canton of Geneva law courts, regardless of the town or country of residence of the involved parties.

Art. 15 – Unless otherwise specified, storage fees at a minimum of CHF 30 per month and per object will be charged for any lot that has not been collected by the buyer within 8 days following the auction. These lots will be sent into storage at the expense and risk of the buyer. The buyer expressly agrees that the unclaimed lot becomes the property of Hôtel des Ventes and authorises the resale as soon as storage costs exceed the price of the low estimate (in the buyer's case) or the reserve price (in the vendor's case).

NB: unless otherwise stated, the dimensions of paintings and furniture are indicated in centimetres and are written in this order: height x width x depth. Unless otherwise stated, books and watches are measured in millimeters. Carpets are “old” if they are more than 30 years old and “antique” if they are more than 80 years old.


Silent Auction Sale

The sale is based on behalf and for third parties.

All participation to the sale implies unconditional acceptance of the following conditions:

  1. The sale is executed strictly in cash, Swiss francs and without warranty.
  2. Visitors are invited to deposit, during the exposition days, a duly signed absentee bid sheet and place it in a sealed box which will be opened and stripped after the exposition under the supervision of the auctioneer

    Absentee bids received by fax or email will also be accepted.

    The object will be awarded to the person who offered the highest bid. However, the successful sale price will be established on the basis of 10% more than the second highest offer.

    For example:

    • Your offer is CHF 1'000.-
    • The second highest offer is CHF 700.-
    • The lot will be awarded to you for CHF 770.- (plus buyer's premium and VAT)

    Increments

    • Between CHF 10.- and CHF 490.-, the increments are of a minimum of CHF 10.-
    • Between CHF 500.- and CHF 950.-, the increments are of a minimum of CHF 50.-
    • After CHF 1'000.-, the increments are of a minimum of CHF 100.-

    In case of a non-compliant bid, Hôtel des Ventes will round up to the lower tier.

    In addition to the hammer price, the successful bidder agrees to pay us a buyer's premium on the hammer price. On all lots we charge a buyer's premium of 20%. VAT of 8% will be charged on the buyer's premium.

    N.B.: In case of special sales, such as sales taking place outside the Hôtel des Ventes area, a commission of 23% will apply, instead of 20%.

  3. The sale catalogue is done with care so that all the indications are correct; however the descriptions you will find are only the expression of an opinion and do not constitute a warranty.
  4. The exposition period allows the buyer to evaluate personally the condition and authenticity of the objects. Claims will not be allowed once the counting of the urn is over. There will be no special notice describing the state of an object (accidents, cracks, losses of pieces, etc).
  5. Ownership of, and risk for, the lot will pass to the buyer when the auctioneer strikes the hammer down accepting the last bid from the buyer of the lot. Any profits following this time shall be for the buyer. However, the buyer becomes the sole owner of the lot only once the invoice has been settled.
  6. The buyer will settle the invoice within 5 days of the ballot counting via wire transfer, major credit cards (except American Express) or cash. Personal or company cheques are not accepted.

    The ballot counting day will be indicated on the first page of the catalogue.

    In the case of identical bids, the computer system on which the bids are placed will randomly select the highest bidder.

  7. The buyer will remove the objects that are now his/her property within the 5 days that follow the ballot counting. The buyer will be contacted, if successful bidder, within 56 hours that follow the ballot counting. All objects that have not been removed from the Hôtel des Ventes premises within 7 days that follow the ballot counting will be brought to a storage box at the expense and risk of the buyer.
  8. Any dispute concerning the sale is subject to the exclusive application of Swiss laws and jurisdiction of the canton Geneva courts of law, regardless of the hometown of the parties.
  9. All the other sales conditions that are present in the main auction catalogue remain valid alternatively.

VENTE AUX ENCHÈRES AU NOM ET POUR LE COMPTE DE TIERS. LA PARTICIPATION AUX ENCHÈRES IMPLIQUE L'ACCEPTATION INCONDITIONNELLE DES PRÉSENTES CONDITIONS DE VENTE:

Art. 1. - La vente a lieu strictement au comptant, en francs suisses et sans garantie. Les bordereaux (factures) sont payables à la fin de la vente en ligne. Des facilités de paiements peuvent être organisées en effectuant un transfert bancaire, les chèques ne sont pas acceptés. Des paiements cash supérieurs ou égaux à CHF100'000 ne sont pas admis.

Art. 2. - L'adjudication sera prononcée en faveur du dernier enchérisseur en ligne.

Art. 3. - Les enchères se déroulent exclusivement en ligne via notre partenaire Invaluable.com . Lorsque le prix de réserve n'est pas atteint, le lot restera invendu.

Art. 4. - L'acheteur paie une échute de 23% en sus du prix d'adjudication de chaque lot, plus TVA 8% sur cette échute, soit 24.84% (frais internet 3% compris). Le paiement de la facture doit nous parvenir dans les 7 jours qui suivent la fin de la vente en ligne. Pour les lots munis d'un astérisque la TVA due par l'acheteur est calculée sur le prix d'adjudication augmenté de l'échute, soit un total de 28.8% TTC.

Art 4a. - Pour les acheteurs domiciliés hors de Suisse, la TVA perçue peut être remboursée sur présentation d'un justificatif de résidence principale étrangère (ex. : permis de conduire ou carte d'identité sur laquelle on lit la même adresse que sur la facture). Des frais administratifs de CHF50.- sont appliqués pour ce service. Pour les lots munis d'un astérisque le remboursement de la TVA n'est possible que sur présentation d'un justificatif d'export

Art. 5. - Les surenchères doivent avoir lieu en ligne sur piguet.com ou sur notre plateforme partenaire Invaluable.com. Le montant minimum des surenchères est fixé à 10%.

Art. 6. - L'exposition permettant aux acheteurs de se rendre compte de l'état ou de l'authenticité des objets, il ne sera admis aucune réclamation une fois l'adjudication prononcée. Le présent catalogue a été réalisé avec soin par nos spécialistes et nos gemmologues diplômés du GIA afin que les indications portées soient correctes, toutefois les descriptions et les rapports de condition ne sont que l'expression d'une opinion et ne constituent pas une garantie.
Le catalogue mentionne certains dégâts sans pour autant y établir une liste exhaustive. Toutes les descriptions des lots ainsi que leur rapport de condition sont disponibles sur piguet.com. Les photographies, dimensions et poids sont fournis purement à titre indicatif.

Art. 6a.- Les acheteurs étrangers doivent se renseigner avant la vente et se conformer aux règles d'importation et d'exportation entre la Suisse et le pays de destination. Piguet Hôtel des Ventes n'est pas en mesure d'apporter une assistance en matière de transport transfrontalier notamment en ce qui concerne les objets comprenant de l'ivoire, de l'écaille ou d'autre matière soumise à règlementation. Piguet Hôtel des Ventes porte une attention particulière à remplir ses devoirs de diligence pour que les lots présentés au catalogue soient conformes à la loi sur les transactions de biens culturels (LTBC)

Art. 7. - Les lots doivent être enlevés aux frais et risques de l'acquéreur. Sauf accord préalable, aucun lot ne sera remis avant le paiement total du prix de vente, surtaxe comprise. Les objets devront être enlevés par les acheteurs dans les 7 jours suivant la fin de la vente en ligne.

Art. 8. - Tout visiteur est responsable à concurrence du prix moyen d'estimation augmenté des commissions et TVA des dommages qu'il cause, de manière directe ou indirecte, aux objets et lots exposés.

Art. 9. - Les ordres d'achats écrits sont exécutés avec soin, discrétion et sans frais.
Toute annulation d'ordres d'achats doit être faite exclusivement par écrit au minimum 24h à l'avance. Pour être valable, l'annulation devra être signée et confirmée par la direction de Piguet Hôtel des Ventes exclusivement.

Art. 10.- Les profits et risques passent à l'acheteur à la fin de la vente en ligne; il ne devient toutefois propriétaire de l'objet qu'une fois le paiement complet effectué. En cas de défaut de paiement dans les 3 jours, l'acheteur s'expose à des poursuites judiciaires. Il s'expose aussi à l'annulation de la vente selon réquisition du vendeur après un délai de 30 jours, tous frais et commissions demeurant à la charge de l'acheteur. L'état des cadres et des vitres ne sont pas garantis.

Art. 11.- Piguet Hôtel des Ventes se réserve le droit de refuser l'accès à ses locaux commerciaux ou d'interdire toute personne de participer à la vente sans indication de motifs ni justification. Piguet Hôtel des Ventes est libre d'écarter une enchère sans en indiquer le motif. Celui qui intentionnellement entrave ou fausse le libre jeu des enchères sera passible de peines de police.

Art. 12.- Piguet Hôtel des Ventes est libre de refuser ou d'accepter un payement par carte de crédit. Il accepte sans frais les cartes Suisses Maestro, Ec direct et Postcard. Les autres cartes (Visa, MasterCard, American Express et UnionPay) font l'objet d'une surcharge correspondant à 2% ou 3% pour carte non européenne (+TVA) du montant total débité comme participation à une partie des frais perçus par l'émetteur de la carte.

Art. 13.- Piguet Hôtel des Ventes se réserve le droit de publier, à des fins publicitaires, des photographies des objets vendus dans ses propres publications et ou à travers d'autres médias. Piguet Hôtel des Ventes est détenteur exclusif du droit de reproduction des photos qui apparaissent dans le catalogue.

Art. 14.- Tout litige relatif à la vente en ligne est soumis à l'application exclusive du droit suisse et à la juridiction des tribunaux du canton de Genève, cela quel que soit le domicile des parties.

Art. 15.- Des frais de garde-meubles par objet d'un minimum de CHF/EUR30.- (+TVA) par mois commencé et des frais d'assurance de 1% du total de la facture par trimestre commencé seront facturés pour tout lot non retiré dans les 30 jours suivant la fin de la vente en ligne. De plus, ils seront transportés en garde-meubles et stockés aux frais et aux risques de l'acheteur.

L'acheteur ou le mandant acceptent expressément que l'objet non retiré devienne la propriété de HDV Hôtel des Ventes SA respectivement du transporteur et en autorise la remise en vente dès le moment où les coûts de stockage ou de transport mentionnés ci-dessus dépassent le prix d'estimation basse (acheteur)/prix de réserve (mandant).

Note: sauf indications contraires, les dimensions des tableaux et des meubles sont en centimètres et s'entendent (hauteur x largeur x profondeur). Sauf indications contraires, les livres et les montres sont mesurés en millimètres. Les tapis sont «anciens» s'ils ont plus de 30 ans et «antiques» s'ils ont plus de 80 ans.
